1. Definitions
"Company" means Windows Factory Pty Ltd (ABN 47 607 947 188). "Customer" means the person or entity placing an order. "Products" means all uPVC windows, doors and associated hardware manufactured and/or supplied by the Company. "Services" means installation, measurement, consultation and any other services provided by the Company.
2. Quotes and Pricing
All quotes provided by the Company are valid for 30 days from the date of issue unless otherwise stated in writing. Prices are in Australian Dollars (AUD) and include GST where specified. The Company reserves the right to amend pricing after 30 days or where specifications change at the Customer's request. A written contract signed by both parties constitutes a binding agreement.
3. Orders and Deposits
A deposit of 50% of the total order value is required upon signing of the contract to commence manufacturing. Orders are only accepted in writing and are binding once the deposit has been received. Once manufacturing has commenced, cancellations are not accepted and deposits are non-refundable. The remaining balance is due upon completion of installation or delivery, whichever occurs first.
4. Manufacturing and Lead Times
Standard manufacturing lead times are 4–8 weeks from confirmed order and deposit receipt, subject to product specifications and current demand. The Company will advise estimated delivery and installation dates at time of order but does not guarantee specific dates. The Company is not liable for delays caused by factors outside its control including supply chain disruptions, weather, or access issues.
5. Measurement and Installation
The Company offers free on-site measurement services. The Customer is responsible for ensuring site access and that the installation area is clear and safe. The Company holds HWI Certificates S.1 and S.2 and a Glazing Licence. All installations are performed by licensed tradespeople. The Customer must inspect completed work at the time of installation and raise any concerns immediately. A completion sign-off form will be presented for the Customer's signature.
6. Products Warranty
The Company provides a 10-year warranty on all manufactured uPVC windows and doors against defects in materials and workmanship, subject to the following conditions:
- Products must be maintained in accordance with the Company's care and maintenance guide.
- Warranty is void where Products have been modified, misused, or damaged by third parties.
- Warranty is void where Products have been installed by parties other than the Company without prior written approval.
- Warranty covers manufacturing defects only — not normal wear and tear, weather damage, or accidental breakage.
- Glass warranty is provided by the glass manufacturer and is separate to the frame warranty.
7. Installation Workmanship Guarantee
The Company provides a 6-year guarantee on installation workmanship. This covers defects arising from improper installation that result in product failure, air infiltration, or water ingress attributable to the installation method. Structural defects in the building opening are the responsibility of the Customer.
8. Payment Terms
Payment is accepted by bank transfer, credit card (surcharge may apply), or via approved finance through Handypay Home Improvement. Finance is subject to the terms and conditions of the relevant finance provider. All invoices are due in full upon completion of works. Overdue accounts may attract interest at the rate of 2% per month on the outstanding balance.
9. Colour and Finish Variations
While every effort is made to match colour samples, the Company does not guarantee an exact match between samples and finished products due to natural variations in manufacturing processes, screen calibration, and lighting conditions. The Customer is advised to view physical colour samples prior to ordering.
10. Limitation of Liability
To the extent permitted by law, the Company's total liability to the Customer is limited to the total value of the order in question. The Company is not liable for consequential, indirect, or special damages including loss of profit, loss of use, or costs associated with delays. Nothing in these Terms excludes or limits any rights the Customer may have under Australian Consumer Law.
11. Dispute Resolution
In the event of a dispute, the Customer must provide written notice to the Company. The parties agree to attempt to resolve the dispute in good faith within 14 days. If unresolved, disputes may be referred to NSW Fair Trading or the relevant tribunal. These terms are governed by the laws of New South Wales, Australia.
12. Privacy
The Company collects personal information solely for the purpose of fulfilling orders, providing quotes, and communicating about products and services. The Company will not sell or share personal information with third parties except as required to fulfil the order (e.g., finance provider) or where required by law. You may request access to or deletion of your data at any time by contacting sales@windowsfactory.com.au.
13. Acceptance
By signing the Company's contract, placing an order, or submitting an enquiry form on this website, the Customer agrees to be bound by these Terms and Conditions. These Terms supersede all prior discussions, representations, and agreements. Windows Factory Pty Ltd reserves the right to amend these Terms at any time.
